Photacular's "Cutie of the Month" Photo Contest Rules

Our photo contest is designed to be a fun way to share our users' best photos with others, giving the photographers some well-deserved recognition and helping to associate the Photacular brand with cuteness.

Contest Rules

1. Who Can Enter

Our contest is open to legal residents of the United States, age 18 or older. Void where prohibited or restricted by law or regulation. Employees and immediate families of Photacular (Sponsor), its agents, or promotion agencies are not eligible. Entrants must create a free Photacular account to enter. No purchase is required.

2. Contest Period

The photo contest will run on a monthly basis. All photos entered each month will be judged together the following month. For example, all photos entered between March 1, 2008 at midnight and March 31, 2008 at 11:59 PM Pacific time will be judged together to receive the March 2008 awards. The March 2008 awards will be announced in April 2008.

3. How to Enter

Entries must be submitted through the photacular.com website. Choose any product listed on the site and click the "Add Your Photo" button to launch the Photacular Designer. Use the Designer to upload a photo and then click the "Continue" button to see the photo contest form. Fill out the form completely, creating a free Photacular account if needed. Please contact us with any questions.

Entries are linked to your Photacular account, which must have a valid email address. Photacular will contact winners via email to request delivery information for prizes.

Entrants can submit as many photos as they would like. Each photo will only be considered for the current month's contest. Entrants can resubmit their photo for a later month's contest if they wish, unless that photo has already won the contest. Each photo can only win one time. If a winning photo is re-entered in the contest, the entry will be discarded.

4. Contest Categories

The contest categories are "cutest person photo" and "cutest animal photo". Each photo will be considered for the appropriate category. If the photo contains both a cute person and a cute animal, it will be considered for either award for the month, but cannot win both.

5. Photo Restrictions

All photos must be in electronic format and submitted via the Photacular Designer as explained in step 3. Photos cannot be more than 10 MB. You may only submit photographs of which you are the sole owner of any copyright or other property or privay rights. Submissions of photographs taken by someone other than yourself are void. Minor digital enhancements are permitted, but photographs that appear to have been significantly modified or appear unnatural will be disqualified.

Any photos depicting harm being inflicted on a person or animal by any person are not eligible for the contest. Any photos causing concern will be turned over to the appropriate authorities.

6. Judging Criteria and Selection of Winners

Photos will be judged on their overall cuteness. Judging will be conducted by a judging panel selected by Photacular. All decisions by the panel are final.

The judging panel will select one winner each month in each category. The panel may, at its own discretion, select additional winners as well.

7. Prizes

Each monthly winner will receive a T-shirt from Photacular with the winning photo, itentifying it as a Photacular contest winner. Winning photos will also be posted on the photacular.com website and may be used in other Photacular promotional materials.

8. Terms

By entering the contest, entrants:

Acknowledge compliance with these Contest Rules, including all eligiblity requirements and copyright ownership of submitted photographs
Agree to be bound by the winner selections of the judging panel, which are final and binding in all respects
Agree that Sponsor has sole discretion to resovle any dispute as it sees fit
Agree that neither you nor your heirs, successors or assigns will assert any claim relating to damages, losses or inuries against Sponsor, or its agents, affiliates, subsidiaries, divisions, attorneys, printers, and advertising and promotion agencies

All entry information becomes the property of Sponsor. Entrants retain the copyright to their photographs; however, by entering the contest, Entrants grant Sponsor a perpetual, irrevocable, royalty-free, worldwide license to display any submitted photographs, Entrant name, city, and state, and entry title on Sponsor website, Sponsor emails, and in Sponsor advertising and promotions without any fee or other form of compensation. Sponsor may make and retain copies of any submitted photograph for contest and archival purposes. If the ownership of any photograph or rights to a submitted photograph is contested in any manner, Sponsor retains the right to disqualify the entry and discontinue use of the photograph.

This contest is subject to U.S. federal, state and local laws and regulations. Sponsor, or its agents, affiliates, subsidiaries, divisions, attorneys, and advertising and promotion agencies:

Makes no warranty, guaranty or representation of any kind concerning any prize
Disclaims any implied warranty
Is not in any way responsible or liable for damage, loss or injury resulting from altered, late, lost, damaged, misdirected, mutiliated, illegible or incomplete entries, or human, telephone, computer, online, or technical malfunctions, failures or difficulties (including busy lines and disconnections) of any kind, or acceptance and use of a prize or travel in connection with such prize. Winner assumes liability for injuries caused or claimed to be caused by participating in the contest, or by the acceptance, possession or use of any prize.

These rules may be amended at any time by us without specific notice to you. The latest rules will be kept posted on the Photacular website at www.photacular.com/photo_contest_rules.jsp.

9. Conditions

Any tax due on the prize is the sole responsibility of the winner. Sponsor reserves the right to verify eligibility qualifications of all winners. All contest entrants hereby consent to the user of his/her name, entry title, and submitted photograph for promotional purposes without additional compensation, unless prohibited by law. Persons found tampering with or abusing any aspect of this contest as solely determined by the Sponsor will be disqualified from winning any prize. If the event the contest is compromised by a virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts or impairs the administration, security, fairness or proper play of the contest, Sponsor reserves the right in its sole discretion to suspend or terminate the contest and award prizes in a later contest. Should the contest be terminiated prior to the stated expiration date, notice will be posted on our website at www.photacular.com/photo_contest.jsp.

10. Privacy Policy and Terms of Service

By entering into this contest you also agree to Photacular's Privacy Policy and Terms of Service.

11. Winners

Winning entries will be posted at www.photacular.com/photo_contest.jsp.
